Notice on Re-Issuing the Administrative and Institutional Charging Items by the Housing and Urban-rural Development Department under the Central Government

The Housing and Urban-rural Development Department, the Finance Departments (Bureaus), Development and Reform Commissions and Price Bureaus of all provinces, autonomous regions and municipalities,


In accordance with the requirement of the State Council for streamlining and reforming the collection of fees, to further regulate the management of administrative and institutional charging items, we hereby announce the charging items by the Housing and Urban-rural Development Department under the Central Government which have been examined and approved anew and their relevant issues as follows:

I. The fees for occupying urban roads. They are collected by the departments of housing and urban-rural development above the county level from the units and individuals who occupy the road within urban planning areas because of constructing various buildings, structures and infrastructures, heaping materials, setting up parking spaces, stands and advertisement signs, etc.

II. The restoration fees for digging urban roads. They are collected by the departments of housing and urban-rural development above the county level from the units and individuals who dig the road within urban planning areas because of constructing and emergency repairing of the underground pipelines.

III. The fees for preventing and controlling termites. They are collected by the termite prevention and control institutions subordinate to the housing and urban-rural development departments above the county level from the units and individuals which shall, in accordance with the law, conduct termite prevention and control in housing construction.

IV. The service charges for transferring housing. They are collected by the real estate trading institutions subordinate to the housing and urban-rural development departments above the county level when they settle the housing transferring formalities. The service charges for transferring newly-built houses shall be paid by the transferors while those for transferring housing in stock shall be evenly shared and paid by the transferors and transferees. The collection scope, object and mode of non-housing transfer service charges shall follow the relevant regulations of the departments of finance and price at the provincial level.

V. The fees for registering housing. They are collected by the real estate registration institutions subordinate to the housing and urban-rural development departments above the county level from the registration applicants when they conduct housing registration. The real estate registration institutions shall in accordance with the regulations issue one property ownership certificate without charging the printing cost of the certificate; if they issue property ownership certificates to more than one right owners of the housing, they can collect the printing cost of the certificate for the additional certificates.

Subsequent to the introduction of the policy concerning the registration fees, the collection of housing registration fees shall be uniformly executed in accordance with the policy concerning the registration fees of real estate.

VI. The fees for organizing examinations. When the Housing and Urban-rural Development Department organize the relevant professional and technical personnel examinations, the certified qualification registry center subordinate to the Housing and Urban-rural Development Department shall collect fees for organizing examinations from local relevant examination institutions, which in turn collect the examination fees from the individuals who sign up for the examination.

VII. The specific charging standards of the above-mentioned charging items shall be separately formulated by the National Development and Reform Commission and the Ministry of Finance or the departments of price and finance at the provincial level.

VIII. The charging units shall, according to levels of affiliation, separately use the bills uniformly printed by the Ministry of Finance or the finance departments at the provincial level.

IX The fees for organizing the professional and technical personnel examinations, which are collected by the certified qualification registry center subordinate to the Housing and Urban-rural Development Department, shall be fully turned over to the Central treasury and incorporated in the Central financial budget management. The specific collection measures shall be executed in accordance with the relevant regulations of the collective collection of the Finance Treasury. The income from the fees collected by the departments of housing and urban-rural development above the county level and the local relevant professional and technical personnel examination institutions shall be fully turned over to the local treasuries and incorporated in the local finance budget management. The specific collection measures shall be executed in accordance with the finance departments at the provincial level. The expenditures required by the charging units for performing their duties shall be arranged comprehensively by the finance department at the same level.

X. The charging units shall strictly follow the above-mentioned regulations. They shall not add charging items and enlarge the collection scope without authorization. Besides, they shall consciously be subject to the supervision and inspection of the departments of finance, price and audit. The acts of violating the law to collect more or reduce, exempt or postpone the collection of fees shall be penalized in accordance with the law and regulations of the Budget Law and the Penalty and Sanction Regulations for Illegal Financial Acts.

XI. The notice shall be executed from the date of issuance. If the previous provisions are in conflict with the Notice, the latter shall prevail.
